In agreeing to hire me as your photographer, I will be granted artistic license in relation to the poses photographed and the locations used. All images are edited at my discretion, and delivered images shall not include all images shot. I reserve the creative right to edit and release only those deemed professional in quality and within my artistic standards. You, the Client, are also allowing me to display any images taken pursuant to this contract in my studios, portfolios, literature, websites, competitions, wedding exhibitions and advertising unless otherwise discussed.
If the Client wishes to purchase prints, he or she can do so via this website. I am not responsible for ordering prints by any means. The Client understands that he or she is solely responsible for purchasing and ordering prints at their own discretion. I am not responsible for negative outcomes of merchandise from the website.
The Client also understands that frames per package is approximate. The Client will most likely not receive edited frames of all images shot. I will only distribute shots that uphold to my professional opinion.
I ask that you please do not re-edit my images. They are given to you because they upload my profession opinion as artistically appropriate. If you edit them, they are no longer under my artistic credit. Re-editing includes cropping (or cropping my name out of the image), changing color tones, contrast, saturation, vibrance, etc.
Only the owner of copyright in a work has the right to prepare, or to authorize someone else to create, a new version of that work. Accordingly, you cannot claim copyright to another's work, no matter how much you change it, unless you have the owner's consent.
If you, the Client, purchased a package that includes the CD of all edited images, you are free to upload them where you choose. However, the Client understands that the unauthorized use of a copyrighted work is an infringement. The Copyright Act provides stiff penalties for infringing copyrighted works. Under appropriate circumstances, penalties can include monetary damages, all profits earned by the infringer from the unauthorized use of the copyrighted work and attorney's fees. A court can also order the destruction of all infringing copies.
